SWG: Utopia, Third Party Vendors or Entities, reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. In that event, you shall have no further obligation to provide indemnification to SWG: Utopia in that matter. This section shall survive termination of the terms and conditions in these Terms of Service.

Taking any sort of legal action, attempting to take any legal action, or suggesting/threatening that you will take legal action against SWG: Utopia, its third-party vendors, or its Entities, may result in disciplinary action being taken against player accounts, which may or may not lead up to and including Official Warnings, Account Suspensions or Account Termination, depending on the severity of the incident, and at the discretion of Leadership.

SWG: Utopia is free, always will be free, and without cost of any kind. You will never be required to pay in order to access any and all of the services provided by SWG: Utopia. Anyone requesting a fee to access any SWG: Utopia Services, is not a representative of SWG: Utopia.

SWG: Utopia reserves the right, at its sole and absolute discretion, to change, modify, add to, supplement, or delete, at any time, any of the terms and conditions of this Agreement, any feature of the Game or the Service, hours of availability, content, data, software or equipment needed to access the game or the service, effective with or without prior notice; provided, however, that material changes to these terms and conditions agreement will not be applied retroactively. If any future changes to this agreement are unacceptable to you, or cause you to no longer be in compliance with said agreement, you must terminate, and immediately stop using, the game and all relevant SWG: Utopia services. For purposes of this EULA "Software" means all software programs distributed, published, or otherwise made available by LUCASARTS & SOE or its affiliates including, but not limited to mobile software, downloadable/installable software for personal computer, and software accessed by means of a browser or other online communication method. The software also includes updates and upgrades as well as accompanying manual(s), packaging and other written, files, electronic or on-line materials or documentation, and any and all copies of such software and its materials.

“Services” means all services made available by LUCASARTS & SOE, including but not limited to services accessed through mobile games, by means of a browser, or by another online communication method. Software and Services are collectively referred to as “LUCASARTS & SOE Services”.

THE SOFTWARE IS LICENSED, NOT SOLD. YOUR USE OF THE SOFTWARE (AS SPECIFIED BELOW) IS SUBJECT TO THE TERMS AND CONDITIONS SET FORTH IN THIS EULA. However, with regards to installable Software that was delivered on a physical storage medium, you may transfer the entire Software and accompanying documentation on a permanent basis to another person as long as you retain no copies (including archival or backup copies) of the Software, accompanying documentation, or any portion or component of the Software accompanying documentation, and the recipient agrees to the terms of this EULA The Software is intended for private use only.

The LUCASARTS & SOE Services may include measures to control access to the LUCASARTS & SOE Service, prevent unauthorized copies, or otherwise attempt to prevent anyone from exceeding the limited rights and licenses granted under this EULA. Only LUCASARTS & SOE Services subject to a valid license can be used to access online services, and download updates and patches. You may not interfere with such access control measures or attempt to disable or circumvent such security features. If you disable or otherwise tamper with the technical protection measures, the LUCASARTS & SOE Services will not function properly.

The LUCASARTS & SOE Services may allow you to create content, including but not limited to gameplay maps, screenshots, or a video of your gameplay. In exchange for the use of the LUCASARTS & SOE Services, and to the extent that your contributions through the use of the LUCASARTS & SOE Services give rise to any copyright, design right, or any other intellectual or industrial property right you hereby grant LUCASARTS & SOE an exclusive, royalty-free, perpetual, irrevocable, fully transferable and sub-licensable worldwide right and license to use your contributions in any way and for any purpose including, but not limited to the rights to reproduce, copy, adapt, modify, perform, display, publish, broadcast, transmit, or otherwise communicate to the public by any means whether now known or unknown and distribute your contributions without any further notice or compensation to you of any kind for the whole duration of the protection granted to intellectual and industrial property rights by applicable laws and international conventions. In order for certain features of the LUCASARTS & SOE Services to operate properly, you may be required to have and maintain (a) an adequate internet connection and/or (b) a valid and active account with an online service as set forth in the documentation related to LUCASARTS & SOE Services. These virtual goods may also be licensed by using third-party virtual currency, such as Facebook Credits, or by using separate activation codes.

Any and all virtual goods are licensed to you on a limited, personal, non-transferable, non-sublicensable, and revocable basis and limited only for non-commercial use. Please note that any payment for licenses for virtual goods or redemption of third-party virtual currency is always FINAL AND NON-REFUNDABLE. LUCASARTS & SOE warrants to you (if you are the initial and original purchaser of the Software) that, to the extent the Software is made available to you on a physical storage medium, the original storage medium holding the Software is free from defects in material and workmanship under normal use and service for 90 days from the date of purchase. If mandatory legislation in your jurisdiction requires longer in excess of the aforementioned 90 days, the length of the warranty is amended accordingly. If for any reason you find a defect in the physical storage medium during the warranty period, LUCASARTS & SOE agrees to replace, free of charge, any physical storage medium and related Software discovered to be defective within the warranty period as long as the Software is currently commercially distributed by LUCASARTS & SOE. If the Software is no longer available, LUCASARTS & SOE retains the right to substitute a similar piece of Software of equal or greater value. This warranty is limited to the physical storage medium and the Software as originally provided by LUCASARTS & SOE and is not applicable to normal wear and tear. TERMINATION: This EULA will terminate automatically if you fail to comply with its terms and conditions. In such event, you must destroy all copies of the Software and all of its component parts and cease and desist from accessing any LUCASARTS & SOE Services. With regards to Software delivered on a physical storage medium, you can end this EULA by destroying the Software and all copies and reproductions of the Software and deleting and permanently purging the Software from any client server or computer on which it has been installed.

EQUITABLE REMEDIES: You hereby agree that if the terms of this EULA are not specifically observed, LUCASARTS & SOE will be irreparably damaged, and therefore you agree that LUCASARTS & SOE shall be entitled, without bond, other security or proof of damages, to appropriate equitable remedies with respect to your breach of any of the terms of this EULA, in addition to any other available remedies. 

AFFILIATE: For purposes of this EULA, an “affiliate” or LUCASARTS & SOE means any legal entity that is directly or indirectly controlled by LUCASARTS & SOE for so long as such control lasts. Control shall exist through direct or indirect ownership of more than 50 % of the nominal value of the issued equity share capital or more than 50 % of the shares entitling the holders to vote for the election of the members of the board of directors or persons performing similar functions.

DUE TO LEADERSHIP ABUSE BEING ALLOWED TO RUN RAMPANT ON SO MANY PROJECTS, WE ARE PUBLICALLY DISPLAYING THE STEPS NECESSARY FOR THE REMOVAL OF LEADERSHIP ON THE GROUNDS OF ABUSE OF POWER, AS WELL AS OTHER INFORMATION REGARDING WHO IS RESPONSIBLE FOR INVESTIGATING ALLEGATIONS OF CORRUPTION AGAINST LEADERSHIP.

The following are specific clauses that leadership are not permitted to do, under any circumstances. Any breaches qualify as Allegations of Misconduct, Abuse, and Corruption, which are:

==Approved Leadership Duties==

Absolutely, no unauthorized, use of GM Accounts. GM or Leadership Accounts are to be only used for authorized actions. GM or Leadership Accounts are not meant to be "played" on and are deemed as support only. Authorized uses, would include, but are not limited to:

<li>Working on Tickets for the Forums</li>
<li>Issues with DM's from Discord or Forums (Stuck Characters, Frozen Characters, etc)</li>
<li>Player and Leadership Events</li>
<li>Ingame Moderations (Viewing or Watching Specific Player or Groups for Exploits, Hacks, Etc.).</li>

==Unauthorized Leadership Duties==

Unauthorized uses include, but are not limited to:

All Leadership must adhere to and uphold the Discord Guidelines, Community Standards Guidelines, Code of Conduct, Character Naming Policy, and all other Legal Guidelines or Policies, just as the player must.

Leadership are not permitted to leak privileged information regarding leadership discussions or topics. Leadership discussions, in any manner, towards content, server, announcements, or the project, are considered privileged and confidential information. Leaking any substance includes, but is not limited to:

<li>Any and all Records or Transcripts</li>
</ul>

Any member of Leadership (Even and Especially Administrators) found to be in breach of these guidelines, will be subject to allegations of misconduct, abuse, and corruption, and will be investigated by thoroughly by the Imperial Security Bureau.

==Imperial Security Bureau==

On the direction of the now defuct Project Administrators, the Imperial Security Bureau has been formed and given the task to root out any and all concurrent Abuse of Power and Corruption within Leadership, as well as to prevent any Abuse of Power and Corruption. The mission of the Imperial Security Bureau is to conduct thorough, timely, and impartial investigations of alleged misconduct and corruption by the members of the {{SITENAME}} Leadership. These investigations will be appropriately documented in a legal and ethical manner. The foundation of leadership is built upon integrity, nobility, and honor; they are accountable to themselves as well as the community as a whole, that which they are entrusted to serve.

The Imperial Security Bureau's primary function is to receive, process, and investigate reports and complaints against members of the {{SITENAME}} Leadership. When a complaint or report is received, every effort is made to ensure that a thorough, timely, and impartial investigation of the allegation(s) contained within the complaint or report. The openness of the Imperial Security Bureau in the acceptance of a complaint or report is a principal element of professionalism and community responsiveness. All complaints or reports are processed and reviewed by the Imperial Security Bureau for review and final disposition.

The duties of the Leadership assigned to the Imperial Security Bureau include, but are not limited to:

<ul>
<li>Thoroughly and Impartially Investigating all Allegations of Misconduct, Abuse and Corruption of Leadership.</li>
<li>Investigating all Allegations in a timely manner.</li>
<li>Record, Register, and Maintain Active Control of all Investigations against Leadership.</li>
<li>Maintain the Confidentiality of the Imperial Security Bureau Investigations and Archived Records.</li>
<li>Prepare a Quarterly Report of Incidents Investigated and/or logged by the Imperial Security Bureau.</li>
</ul>

In the event that members of Leadership are found guilty of misconduct, abuse, or corruption, the Imperial Security Bureau has the authority to fire him or her, without administration review. The results of all complaints and allegations are called findings and are compiled and assigned one of five, possible, classifications:

<li>Sustained: The allegation is supported by sufficient evidence to conclude the commission of the allegation(s).</li>
<li>Not Sustained: There is insufficient evidence to either prove or disprove the complaint or allegation(s).</li>
<li>Unfounded: Proof exists that the accused was not involved in the incident or the incident did not occur.</li>
<li>Exonerated: The incident occurred, however, the accused action's we were justified, lawful, or in accordance with Standard Operating Procedure.</li>
<li>Withdrawn: The complainant freely and voluntarily withdraws the complaint or allegation. The matter will be dropped, thereafter.</li>
</ul>

<li>Organizing, holding, or participating in protests held in high-traffic areas (such as busy Starports, or other areas where many players would normally gather. 
 
Causing a disruption may result in disciplinary action being taken against player accounts, which may or may not lead up to and including Official Warnings, Account Suspensions, or Account Termination, depending on the severity of the incident, and at the discretion of Leadership.</li>

<li>YOU MAY NOT DEFRAUD OTHER PLAYERS OR MEMBERS OF LEADERSHIP. 
 
FRAUD IS DEFINED AS FALSELY REPRESENTING ONE'S INTENTIONS IN ORDER TO MAKE A GAIN AT ANOTHER'S EXPENSE. EXAMPLES OF THIS ACTIVITY INCLUDE, BUT ARE NOT LIMITED TO, OFFERING TO CRAFT A WEAPON WITH A BUILT-IN POWERBIT FOR ANOTHER PLAYER, AND THEN KEEPING BOTH OF THE COMPONENT, THE WEAPON, AND CREDITS, AS WELL AS USING THE INHERENT FLAWS IN THE SECURE TRADE WINDOW IN ORDER TO DEPRIVE ANOTHER PLAYER OF ONE OR MORE OF THEIR ITEMS OR CREDITS. OTHER EXAMPLES INCLUDE SELLING DISABLED VEHICLES, RENAMING ITEMS AND SELLING THEM AS A DIFFERENT ITEM, OR VIOLATING ANY TRADE AGREEMENT (SUCH AS AGREEING TO CRAT AN ITEM FOR RESOURCES BUT KEEPING BOTH THE ITEM AS WELL AS THE RESOURCES). Disciplinary issues involving Player Associations will also be addressed on a broader basis. Player Associations, whose members, habitually violate any of the Terms of Services, Rules of Conduct, or Community Policies, may be disbanded, with or without warning. In addition, monopolizing numerous spawn areas, with the intent to exclude other players will not be permitted. If investigated and verified by Leadership, monopolizing may result in the disbanding of a Player Association. As stated in section eight (8) of the Rules of Conduct, which states that Player Association Leaders who condone, participate in, or knowingly allow such action, may be held accountable for the actions his or her members.</li> 

<li>You may not intentionally circumvent the Player Vs. Player Combat features and causes another player to die, such as by “training” them. 
 
Training is defined as pulling or leading a hostile NPC or creature along behind you, and then attempting to get said NPC or creature to attack another player, who does not desire said engagement.

<li>You may not abuse players, Leadership, or the Tools provided to request support.</li> 

<li>The act of being Away From Keyboard (AFK) across the entirety of SWG: Vision of Hope is prohibited in areas that involve a quest or quest line, i.e. Legacy or anywhere else that is part of a quest or series of quests. Any player farming an area that is part of a quest or series of quests must give way to players coming through for the related quest or series of quests. Any players suspected of or found in violation of this policy will be removed from the area by Leadership.</li> 

<li>Role Playing or Testing does not grant a license to violate these rules. 
 
Though Star Wars Galaxies™ is a roleplaying game set in the Star Wars Universe, the claim of “roleplay” or “testing” will not be accepted in defense of any of the anti-social behaviors mentioned above. In all cases, either side may appeal a verdict handed down, whether it is a Leadership Member or a member of the Community, which are:

The party who filed the appeal, known as the appellant, must show that either the original decision made a legal error that affected the decision in the case, or that the imposed sentence should be reduced or nullified. The appellant prepared a written document, or brief, discussing the legal arguments. In the brief, the appellant tried to explain that the original decision was in error and that its decision should be reversed. In this process, appellants cite previous precedent that supports their legal argument.

The party defending against the appeal, known as the appellee, also has the chance to defend their position as to why the original decision was made to convince the Appellate Board to uphold the original decision and deny the appeal.
